Use of this website indicates that you agree to be bound by these Terms and Conditions regardless of whether or not you choose to register or order from us. If you do not accept these terms please do not use this website.

The www.kingstonjewellers.co.uk website is operated by: Kingston Jewellers Yorkshire Ltd a company registered in England and Wales. Our registered office is at  22 Ropergate , Pontefract , West Yorkshire , WF8 1LY

 You will be able to access most of this website without registering your details with us but please bear in mind that certain areas are only open to you if you register.

We may revise these Terms and Conditions at any time by updating this posting meaning you need to check from time to time as any changes are binding. Certain provisions contained in our Terms and Conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

Ordering from us

 You are deemed to have placed an order with us once you have used our online checkout process or you have placed an order over the phone or at our showroom. As part of our checkout process you will be given the opportunity to recheck your order and to correct any errors. On receipt of your instruction we will send an acknowledgement detailing the item(s) you have requested.

Acceptance of an order is deemed to have taken place when we send a confirmation email. At this stage the purchase contract will come into effect and you will be charged unless we have notified you previously that we are unable to accept your order or have received a timely cancellation.

Any order may be refused at our discretion. Circumstances likely to result in a refusal are:

  1. a) where we cannot obtain authorisation for your payment
  2. b) if there has been a pricing or product description error
  3. c) if you do not meet any eligibility criteria set out in our terms and conditions
  4. d) where goods, services or information ordered by you are not available
  5. e) if we do not deliver to your area
  6. In the event that we do not accept your order but have processed your payment we will re-credit your account as soon as possible. This will be no longer than 30 days from receipt of your order. We will not be obliged to pay any additional amount as compensation for disappointment.

We will do our absolute best to achieve a requested target delivery date, but we are not liable to pay compensation should we fail to meet a target date.

 

Prices

 All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

 

deliveries

We will deliver goods as soon as possible to the address you gave us for delivery.

f the items we deliver are not what you ordered, are damaged or defective, or the quantity is incorrect, we shall not be liable unless you notify us, in writing, at our contact address within 10 working days of delivery.

If you do not receive your items within 21 days of your scheduled delivery date we shall not be liable unless you notify us, in writing, at our contact address within 10 days following the 21 days.

you notify a problem to us under these conditions you have the right to request one of the following options:

  1. a) that we make good any shortage or non-delivery
  2. b) that we replace or repair any damaged or defective goods
  3. c) that we arrange a refund

 

Product Liability

 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 4.3(c) above.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 

Cancelling orders – b2c customers

 This section applies to consumers only (not businesses or other organisations) who place an order with us.

If you wish to cancel your order prior to dispatch please notify us by email to sales@kingstonjewellers.co.uk. Where goods have already been dispatched you must return them to us in accordance with our returns policy.

You can return goods you have ordered from us for any reason, except where the item is excluded as in our returns policy. The return must be made within 30 days of dispatch for a full refund or exchange, provided that you return the item in an unworn, as new, condition, in its original packaging and with all documentation and labels /tags.

Items not covered by our money back guarantee include rings with engraving and bespoke designs that we have created, or customised designs. This ensures you can be sure of the detailing before we cast your piece of jewellery.

Upon receipt of the returned goods we will give you a full refund or an exchange credit as required.

Any rights to return the goods to us will not apply if the product has been used or has been made or customised specifically for you. The provisions of this clause do not affect your statutory rights.

 

REGISTRATION

To register with www.kingstonjewellers.co.uk you must be at least eighteen years of age.

Each registration is for a single user only, whether or not acting on behalf of a company or other organisation. We do not permit you to share your user name and password with any other person nor with multiple users on a network.

Responsibility for the security of any passwords rests with you and if you know, or suspect, that someone else knows your password you should contact us immediately.

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

  1. e) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977)

  3. g) misrepresentation as to a fundamental matter
  4. h) any liability which cannot be excluded or limited under applicable law

you agree, on behalf of yourself and your business entity or organisation, jointly and severally to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this website or our services, or the use by any other person using your registration details.

 LAWS & GOVENENCE

 These terms and conditions shall be governed by, and construed, in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts where the claim is brought by you, save where you have legal rights to bring any claim in respect of such a dispute in any other jurisdiction. We nevertheless retain the right to bring proceedings against you for any threatened or actual breach of these terms and conditions in your country of residence, registration or business or any other relevant country.

We do not warrant that materials, services or information for sale on the website are appropriate or available for use outside the United Kingdom. It is prohibited to access the website from territories where its contents are illegal or unlawful. If you access this website from locations outside the United Kingdom you do so at your own risk and you are responsible for compliance with local laws.

 MISCELLANEOUS

No person, other than the parties to these terms and conditions, are intended to benefit from them pursuant to the Contracts (Rights of Third Parties) Act 1999 .

You may not assign, sub-license, or otherwise transfer any of your rights under these terms and conditions.

if any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

  NO REFUNDS AND NO EXCHANGES 

 All items are available for enquiries prior to bidding. Written and oral descriptions are our opinions and should in no way be construed as a guarantee of any kind as to authenticity, age, condition, materials or any other feature of items being sold. We will attempt to catalogue every lot correctly and will attempt to point out any defects but will not be responsible or liable for the correctness of the catalogue or other descriptions of the lot. We recommend prospective bidders examine all items in which they have an interest. By placing a bid via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question.

The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt on our part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. If any dispute arises after the sale, the sale record is conclusive.

The purchaser assumes full responsibility for items at the fall of the hammer.

PAYMENT: We accept payments through Shopify pay only unless agreed with Kingston Jewellers Yorkshire prior. For items purchased online, you will be emailed an invoice within 24 hours after the auction. It is your responsibility to contact us or email us at sales@kingstonjewllers.co.ukif you are having problems sending payments.

IF THERE IS A CASE OF A REFUND BEING ISSUED, A RE-STOCKING FEE OF 20%, SHIPPING FEES AND BUYER’S PREMIUMS WILL NOT BE REFUNDED. ALL ITEMS WILL HAVE TO BE RETURNED IN ORIGINAL, UNDAMAGED PACKAGING AND ORIGINAL TAGS STILL ATTACHED.

PLEASE BID RESPONSIBLY AND ASK ALL QUESTIONS PRIOR TO PLACING A BID.

WE RESERVE THE RIGHT TO WITHDRAW ANY LOT AT ANY TIME BEFORE, DURING, OR AFTER THE AUCTION.
